Alimony and assets dispute for Florida couple

One couple is continuing an ongoing legal battle related to the end of their marriage. The alimony and assets divorce case has been remanded back to the trial court by an appellate court. The Florida couple's significant assets and financial relationship with a former father-in-law has complicated the resolution of the case.

The ex-wife was not satisfied with the initial divorce ruling in the trial court. Instead of receiving the $20,000 per month in permanent alimony she requested, the initial court ruling gave her $2,500 per month and a rental property. She also was not satisfied with the court's ruling about both parties having to pay for a property sale to her ex-father-in-law, the court's assessment of the value of her ex-husband's stocks and the rejection of having her legal fees paid.

She appealed the case, and the appellate court remanded many of the claims back to the trial court. The alimony issue was sent back to determine what the ex-husband could actually pay per month. The court also agreed that the lower court erred in its assessment of the stocks and the ability of the ex-husband to pay alimony from those stocks. The court also didn't agree about the payment of the ex-father-in-law for the property. To round it all out, the court also remanded the legal fees claim back to the trial court in the event that the ex-wife accrues more legal fees due to the remands.

This is one divorce case where the alimony and asset considerations became complicated. Without the help of her attorney, the ex-wife would likely be struggling to argue her case. Other individuals in Florida who are unable to come to a workable solution with their ex may also choose to enlist he services of an attorney for help in settling their divorce.
