Additional child support for private school tuition

For many Florida parents, private school is a must for their children's education. When a couple is no longer together, it may be prohibitively expensive for one parent to pay the cost of the tuition alone. Some custodial parents then ask for courts to order additional child support amounts to help them pay for their children's private school education.

Judges do not automatically order parents to pay for private school tuition for their children. They may order it in some cases, however. Judges will consider several different facts about the child and the parents in order to decide whether or not to add a portion to the child support amount to pay for tuition.

If a child attended private school while the parents were together, and the paying parent starts objecting to it only after the child support request is made, the court is likely to order the parent to pay for it. People who were more affluent while they were together are also more likely to receive orders to pay private school tuition. The court will also look at whether or not the parents discussed private school with each other and when the discussions occurred.

Courts make these types of family law decisions according to what the judges believe to be in the best interests of the child rather than what is in the best interests of the parents. In this instance, they will look at whether uprooting a child from a comfortable environment will be upsetting. A parent who is in this situation may want to meet with a family law attorney to learn about what other factors might be considered.
