Grey divorces are on the rise

While divorce rates have been relatively steady overall for the past 10 years, older couples are divorcing at a higher rate. Florida residents may not know that one of the reasons why divorce rates in general have stabilized may also be why older folks are getting divorced at an increasing rate. It is because people are living longer than ever and getting married later in life.

Therefore, younger couples are married because they want to be with their spouse forever. As people age, they may realize that they want to spend the last portion of their lives doing what they want to instead of being stuck in a relationship that may not be gratifying. Today, woman have more economic stability, which may allow them greater freedom to leave a relationship that they don't want to be in. Statistically, women are more likely to file for divorce than men.

The reasons for divorce vary from getting out of an abusive relationship to an evolving meaning of what retirement is. For those over the age of 65, they may be on their second marriages and dealing with the social and financial issues related to having a blended family. That is why their divorce rate is even higher than those who are 50 and over, which has doubled itself between 1990 and 2014.

While the legal issues that older couples face when they go through a divorce are in general similar to all divorces, the property division aspect can be particularly challenging. The couple may have accumulated a lot of assets, and one or both may have retirement accounts that they are already drawing from but which may need to be divided. An attorney can be of assistance to an older divorcing client in negotiating a settlement agreement that will address that matter.
